  1. Program Summary.

    DFC, Smile Card is an internal program which is offered to DFC (Dental First Care) patients.  Benefits from the program are only accessible at Dental First Care offices. For locations of DFC (Dental First Care)  offices, go to: www.dentalfirst.care THIS IS NOT AN INSURANCE PROGRAM or registered or regulated discount or insurance plan. Payments made for the Program are not insurance benefits. The Program cannot be utilized in addition to dental insurance and is not meant to take the place of health insurance.
  1. Membership Term; Automatic Renewal.

    OncetheMembershipFeeisreceived, (“Activation Date”)Program participants will be entitled to discounted prices at DFC (Dental First Care) dental offices for a selection of dental services. Program Membership is valid for a year starting on the activation date and automatically renews for successive one-year periods on the anniversary of the activation date.Program participant information will be saved and stored so that it can be used for future transactions on their account (such auto-renewal), which can be carried out at any DFC (Dental First Care)  location.
  1. Membership Fees.

    Even if the member did not use the plan for treatment, the Membership Fee is non-refundable after the plan has been used for the member’s treatment or 30 days following the activation or renewal date. For upcoming membership terms, DFC (Dental First Care) reserves the right to modify the membership fee.
  1. Additional Members.

    A primary member may include members [up to 6 total on a Program Membership] at any time during the Membership Term for an extra Membership Fee per additional member. All additional members on the Program Membership are subjected to the principal member’s Membership Term date. 
  1. Program Advantages.

    Only the methods described on the DFC (Dental First Care) website, dentalfirst.care, are included in the program. Members understand that there may be out-of-pocket costs involved, that not all dental services relating to the condition will be provided by their dental provider(s), and that some age groups may not be treated. Members give DFC (Dental First Care) and the treating providers permission to use and disclose their dental records and health information to other DFC (Dental First Care)  locations and providers as permitted by law. 
  1. Program Exceptions.
  1. Program fees cannot be used in conjunction with dental discount plans, other insurance benefits, third-party discounts, coupons, or offers, copayments or deductibles for medical or dental insurance, or any other special offers or sales promotions promoted by DFC (Dental First Care).
  2. Treatment that begins before the Activation Date or after the patient’s Membership Term expires or ceases for whatever reason is not subject to Program Fees.
  3. DFC (Dental First Care) practitioners may only do prophylactic cleanings on individuals who have healthy gum tissue, according to their findings. If periodontal disease is found, patients may need periodontal therapy and procedures, which cost more than prophylactic cleanings.
  4. Program Fees are charged for operations carried out by or under the direction of a general dentist from DFC (Dental First Care), or as otherwise noted on the price schedule. Unless otherwise specified, specialist services and costs are not included in the Program.
 
  1. Membership eligibility and DFC Dental rights.

    A minimum age of 18 is required to join. Anyone under the age of 18 must have a parent or guardian who signs the enrollment form, unless they are otherwise legally emancipated. DFC (Dental First Care)  retains the authority to ask any member for identification or to demand documentation of their dependency.DFC (Dental First Care)  maintains the right, in its sole discretion, to refuse Program Membership to any person for any reason that is not illegal. If the member does not abide by DFC (Dental First Care)  policies, such as failing to promptly pay for any operation or for any Fee when due, failing to pay any cancellation Fee for skipping an appointment, or for giving DFC (Dental First Care)  incorrect or misleading information, the Membership may be revoked and canceled.When a member cancels or terminates their membership, all benefits end. Any member who violates these Program T&Cs, DFC (Dental First Care) policies, or DFC (Dental First Care)  medical/dental advice, referrals, or treatment plans may get treatment refusal from DFC  (Dental First Care) and its providers.
  1. DFC+ Fee Schedule.

    Benefits of membership are only available for the fees listed in the DFC+ Fee Schedule. Program Fees only apply to general dentistry and are minimum fees. DFC+ Fees are analyzed and revised on a yearly basis. Although DFC maintains the right to correct (and alter) any Fee for billing or clerical errors, without prior notice to members, DFC+ Fees are fixed and do not increase throughout each calendar year. The DFC + Fee in force at the time each such process is commenced is the applicable Fee for every procedure that is done.   1. Maximum Liability.

    DFC’S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE PROGRAM, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, IT SHALL NOT INCREASE MORE THAN THE APPLICABLE MEMBERSHIP FEE PAID BY THE MEMBER FOR THE ONE-YEAR MEMBERSHIP TERM.
  1. No Guaranties and Disclaimer of Warranties

    Program Services and specific procedures may not be available in every DFC (Dental First Care)  practice. The DFC (Dental First Care)  provider will present a treatment plan based on the member’s clinical evaluation. Procedures vary for each person and with the complexity of the case. A provider’s professional opinion may be that a specialist is required to perform a given procedure. DENTAL FIRST CARE DOES NOT GIVE ANY WARRANTY, EXPRESS OR IMPLIED, AS TO DESCRIPTION, QUALITY, MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, PRODUCTIVENESS, OR ANY OTHER MATTER, FOR ANY SERVICES OR PRODUCT PURCHASED OR RECEIVED BY A MEMBER FROM A DENTAL PROFESSIONAL OR VENDOR THROUGH MEMBERSHIP IN THE DFC+ DISCOUNT PROGRAM. Any complaint regarding professional services shall be directed to the treating dentist and if not resolved then to contact@dentalfirst.canalcero.digital
  1. Disclosures and disclaimers required by law.

    Reduced Fees provided by the Program are not insurance benefits, and neither is this Program insurance, nor is it a licensed or regulated insurance plan. According to the Affordable Care Act, this program is not a qualified health plan. Depending on the kind of provider and service, there are different discount levels. Providers are not paid directly by the Program.
  1. Florida Residents:

  1. Submitted information; Authorizations.

    You must provide personal information (referred to as “Bill Pay Information”) as well as payment information (such as credit card type, credit card number, and credit card expiration date) while using our online bill pay service. The accuracy, completeness, and up-to-dateness of the Bill Pay Information that you enter are your entire responsibility. Regarding the accuracy of the information you supply, Company shall have no duty to you or to any third parties.Additionally, you grant us permission to provide your DFC provider access to whatever information you give the company, including your Bill Pay Information. You understand and agree that we may employ certain third-party vendors (the “Third Party Vendors”) to handle your payments and maintain your Bill Pay Information. You also give permission for information about you and your DFC (Dental First Care)  Dental account to be shared with Third-Party Vendors handling your payments or managing your Bill Pay Information.
  1. Payment Policy Procedure

    When a procedure is carried out, the Member is required to pay all Fees and associated costs in full, with the exception of treatments requiring numerous appointments (such as crowns, bridges, and dentures). Every visit with a dentist or hygienist that lasts 90 minutes or more, as well as every appointment (except from consultations) with a specialist, requires the member to submit a deposit equal to 10% of the total Fee for the planned service (s).Any appointment that is missed for any reason due to failure to arrive within 15 minutes of the specified time or failure to cancel at least 24 hours in advance will be considered broken. The member will be charged a fee, and any deposits already paid for the planned surgery or treatment may be forfeited as a result. Any inconsistencies between this payment policy and any other terms and conditions relating to care or payment in any other DFC (Dental First Care) document or form or on its website will be resolved in favor of this payment policy.
  1. Authorization and accountability for payments.

    You give DFC (Dental First Care) permission to charge and/or debit the account listed on your bill pay information for the costs associated with the DFC (Dental First Care)  services. Due to your use of the Bill Pay services, Dental First Care is not liable for any fees or charges that result from insufficient funds, failed charges, or debits. You consent to reimburse DFC (Dental First Care)  for any unpaid fees or charges not gathered using bill payment information.
  1. General Terms. 
  1. T & C Amendments Procedures and Program Terms & Conditions (“T&Cs”) are subject to alteration, modification, or replacement. It is the member’s responsibility to study the most recent T&Cs posted on the DFC website. Members have the option to get the terms and conditions in non-electronic form; to do so, they need get in touch with DFC.
  2. Costs and expenses related to litigation.The laws of the State of Florida will be used to the construction and interpretation of this Agreement. The Palm Beach County, Florida court, whose jurisdiction member hereby submits, will be the sole and exclusive forum for any dispute arising out of or relating in any way to this Program. Any winning party in such action will be granted reimbursement for its reasonable costs and attorney fees.C.Assignment. The membership in the program cannot be transferred or assigned by the Member.D.Severability. The remaining terms will be interpreted and enforced to the maximum extent of the law if any provision is found to be unlawful, invalid, or unenforceable under any current or future relevant legislation
  3. Headings. None of the terminology or provisions of the Program are defined, modified, expanded, or limited by the titles designating the sections and subsections; they are solely there for reference.By physically signing or electronically accepting the terms and paying the appropriate membership fee, a member enrolls themselves and any other people they choose into the program and accepts its terms and conditions.
